The Commons Justice Committee has called for some data protection offences to be made criminal offences, especially reckless or repeated breaches. At present, government departments cannot be held criminally responsible for data protection breaches. The committee found there was a "widespread problem" and "systemic failings" in the government's handling of personal data.

The Committee also called for a legal obligation to report significant data losses to those affected and to the Information Commissioner. The Government has said that it welcomes the suggestions and is looking into toughening up the Data Protection Act.
