Northern Rock and FOIA

The legislation providing for Northern Rock plc to be nationalised has caused controversy as it is drafted so that Northern Rock is deemed not to be a publicly-owned company for the purpose of the Freedom of Information Act 2000 (FOIA), and so is not subject to the FOIA regime. 

The FOIA would otherwise give the public access to information held by the bank, since it allows the public to access information held by public authorities including publicly-owned companies. The House of Lords had requested an amendment so that the legislation fell with the FOIA, but that was rejected.
