Response to information requests

The ICO has issued an enforcement notice against Hounslow Primary Care Trust following the Trust's failure to respond adequately to information requests, missing key deadlines for responding to both the requester and the Information Commissioner, and numerous other breaches of the Data Protection Act. Amongst the omissions was a failure to respond to requests from the ICO to see relevant information to enable the ICO to make a decision regarding disclosure. An Information Notice was served ordering the Trust to supply the required material.

The Trust again failed to respond and so the ICO served draft High Court papers on the Trust certifying that it was in contempt of court for failing to respond to the Information Notice. This is the first time this has happened under the Freedom of Information Act. The Trust did then provide the information to the ICO.
