Overview

Brian specialises in transport and public law. His extensive experience includes complex dispute resolution including expertise in mediations and other forms of alternative dispute resolution, in regulatory tribunal hearings and proceedings at the European Court of Justice and at every level of the domestic courts.

He advises and leads on a range of matters in the transport sector (in particular, road, rail, ports and integrated transport issues), public law and judicial review, regulatory issues, contractual issues relating to the supply of goods and services and competition issues. He chairs the firm’s Transport Technology and Intelligent Mobility group and is an expert on emerging regulation for new transport modes and mobility models.

On contentious matters, Brian plays a lead role in our dispute resolution team, Brian works with his colleagues to help clients arrive at the right solution to their issue, minimising impact and maximising success. He is supported by our extensive dispute resolution practice with a proven track record in the highest-profile cases and cross-border, multi-sector expertise.

Experience
  • Advising Eurostar on its successful defence of a high profile procurement challenge by a large train manufacturer in relation to its purchase of a new fleet of high speed trains and on safety and economic regulatory matters.
  • Acting for Redde plc in a series of test cases on core legal, regulatory and insurance issues before the Commercial Court, Court of Appeal, Supreme Court and the European Court of Justice (preliminary ruling procedure).
  • Acting for FirstGroup plc's UK bus division on the prosecution and management of multiple statutory appeals to the Secretary of State for Transport and on judicial review.
  • Advising on rail franchise mobilisation and handout in connection with the TransPennine Express franchise.
  • Advising a major UK supermarket in respect of appealing of fines issued by the Competition and Markets Authority.
