Burges Salmon shortlisted for Private Equity Team of the Year (Funds) at Legal Week Awards 2019

The Private Investment Funds team, led by Jeremy Bell, has received the shortlisting for the work it has carried out advising Ipex Capital on the complex winding-up of its Ipex 1 Fund

As the termination of its 10 year term, the Fund owned potentially valuable unlisted assets and instead of the usual default option of selling the assets and distributing the cash proceeds, Ipex Capital wished to offer investors a choice to take either cash proceeds or a distribution of their share of the unlisted assets, including escrowed assets. This involved overcoming a number of hurdles, particularly given the large number of investors spread across the UK, USA and Australia and elsewhere, including looking at a number of solutions, undertaking detailed technical fund term revisions and liaising with the portfolio companies.

Jeremy Bell comments: “We’re pleased to be working with our client to help solve the challenge of enabling it to offer investors a choice on winding up to take assets or cash, which has required navigating some complex fund issues as well as considering a variety of solutions. The overall complexity and resulting innovation that has been required is significant.

“We’re therefore delighted to have been recognised for our work through this shortlisting at the Legal Week Awards 2019.”

Winners of The Legal Week British Legal Awards will be announced at an awards dinner at The Ballroom Southbank on Thursday 21 November 2019.
