Overview

Alastair heads the firm's rural property team within the real estate department and is a core member of the food and farming specialist team. He works full time on the purchase, sale, leasing and mortgaging of rural property, as well as advising on farming structures and the Common Agricultural Policy. He is listed as a Band 1 lawyer in Chambers 2016.

Alastair has been a principal contributor to the Agriculture volume of ‘Butterworths' Forms & Precedents’ and to ‘Mid Term Review: A Practical Guide’, and is the editor of the Pink Book 2: the Burges Salmon guide to the law for farmers and landowners. He is a trustee of the Frank Parkinson Agricultural Trust and the Royal Agricultural Society of England.

He has lectured extensively on issues such as development clawback, shooting rights, SDLT, restrictive covenants and other issues relating to the ownership and occupation of rural property.

Experience
  • Acting for the Co-operative Wholesale Society on the sale, for £249 million, of its Farmcare business together with 17,000 acres of land in England and Scotland, with rights to farm a further 21,000 acres.
  • Advising a farming family on the acquisition of the freehold interest in its tenanted farm for over £10 million, funded by finance secured on the new and on pre-owned land and by the sale of over 50 acres of land with strong development hope value.
  • Acting for a well-known bank in refinancing a family estate (comprising trust, corporate and personally owned land) in Gloucestershire.
  • Advising on the acquisition of a large agricultural estate (including windfarm) for over £15m in the North of England for The Crown Estate.
  • Advising on the complex partition of farming estate in the East Midlands to resolve a dispute including structure to share mineral extraction rights.
