Overview
Marcus is a director in the firm’s projects team who specialises in major PPP (including PFI/PF2) and other outsourcing projects, particularly in the Infrastructure, Transport and Public Sectors. 

Marcus has extensive experience in advising both public and private sector clients across a range of specialist areas, including Defence, Education, Outsourcing, Rail and Highways and Road Transport.  Marcus has a comprehensive understanding of all aspects of PPP/PFI/2 arrangements, including the negotiation of key project documents, providing legal input into the development of technical specifications and payment mechanisms and the effective management of the interests of key stakeholders (including lenders, commissioners, sponsors, regulators and end users).  

Marcus is also a member of the firm’s Infrastructure Sector Group.
Experience
  • Advising Ascent Flight Training Ltd (a joint venture between Babcock and Lockheed Martin) on its £2.3bn procurement (on behalf of the Ministry of Defence) of fixed wing training aircraft, helicopters and other related infrastructure and equipment to support delivery of the UK Military Flying Training System.
  • Advising Transport for Wales and Welsh Ministers on the £5bn franchise of the Wales and Border Rail Services and South Wales Metro.
  • Advising the Department for Education in relation to innovative, ‘first of their kind’ outsourcing/‘contracting out’ models in respect of its intervention programme relating to persistently/systemically failing local authority children’s services provision.
  • Advising Birmingham Children's Trust on its establishment and the delegation to it of Birmingham City Council’s statutory functions relating to children’s social care.
  • Advising Sunderland City Council on the creation of Together for Children Sunderland Limited and the delegation to it of specified statutory functions relating to children’s social care and education.
  • Advising the Freight Operating Companies (all six) in relation to the commercial arrangements that underpin Network Rail's implementation of the European Train Control System (ETCS) Freight Project in the UK.  
  • Advising FirstGroup plc on a range of rail projects including its successful bid for the South Western franchise, mobilisation activities in preparation for running rail services on successful franchise bids and assisting in the management of major changes under existing contracts.
  • Advising a leading retailer (plc) on the arrangements for the operation of a rail freight terminal at one of its sites.
