Overview

David is a senior associate within the construction and engineering team. He specialises in advising both public and private sector clients on resolving potential disputes and has particular experience in resolving issues in complex projects, including those involving PFI/PPP projects.

Where it is not possible to resolve disputes through negotiation, David has experience in all forms of dispute resolution, including adjudication, mediation and litigation.

Experience
  • Assisting developers and contractors in claims for the cost of rectifying defective cladding and other fire stopping defects in high-rise housing developments.
  • Advising a design and build contractor in relation to a claim brought against it for a number of defects caused by both workmanship breaches and faults in the design.
  • Advising a housing association in a series of payment notice adjudications arising as a result of defective repair and maintenance work.
  • Advising a local authority in a series of adjudications arising as a result of the defects in a highway improvement scheme.
  • Advising an NHS Trust in respect of a claim against their PFI Project Co in relation to defective pipework, and negotiating the replacement of all pipework at the hospital.
  • Advising an NHS Foundation Trust in connection with a dispute in relation boilers following installation. Advice was in relation to a claim for direct losses and consequential losses for lost energy efficiency gains.
  • Advising PFI Project Co in relation to defects in the construction of hospitals pursuant to PFI agreements, and pursuing the construction company for the rectification of those works.
  • Advising an NHS Trust on a long-standing disagreement between the Trust and a design, installation and maintenance supplier in relation to issues with a new energy saving technologies.
  • Acting for a large international construction company on a number of disputes including defending a claim brought by a developer against the construction company arising from defective mortar used in the construction of several nursing homes built in exposed locations in the South East. Investigating and pursuing claims against the structural engineer for negligent specification.
  • Representing a local authority in pursuing a number of claims against construction companies instructed to carry out maintenance works to their motorways.
