Overview

Kate is a Director in Burges Salmons’ national real estate practice. She is a highly experienced agricultural property lawyer having qualified in 1999. Kate lives and works in Cumbria and is well placed to service clients across the country but, most especially, in the north of England. Kate joined Burges Salmon on qualification in 1999 but relocated to Cumbria in 2005 where she worked for a local firm, latterly as a director and responsible for the running and management of the firm’s specialist rural office. She re-joined Burges Salmon in 2021.

Kate has acted for individuals, charities, landed estates, institutional and corporate clients in a full range of rural property matters such as agricultural tenancies, lending, surrenders, farm sales and purchase and estate management issues. She also has a particular interest in acting on the sale and purchase of country residences and estates with a residential/agricultural mix.

Experience
  • Acting on the sale of a substantial estate in Oxfordshire for c. £20m with a residential/commercial and agricultural mix (described as “one of the biggest country house sales in 2022”). 
  • Acting for a conservation charity in its acquisition of a number of substantial agricultural sites for conservation purposes.
  • Working as a senior member of a cross departmental team acting on the sale of two agricultural estates with a total acreage of over 8,350 acres. The sale involved diverse assets including 20 residential properties and 30 wind turbines.
  • Acting on the disposal of a £2.8m Estateto include the disposal of previously unregistered shooting and fishing rights. 
  • Bespoke drafting of “overarching agreements” to deal with all aspects of settlements following succession tenancy claims.
  • Registering sporting rights over areas of land in Cumbria.
  • Advising a National Utility company on common rights in the context of their proposed renewable energy projects.
  • Acting for a number of national energy companies to facilitate vacant possession for development by way of complicated surrenders of agricultural tenancies.
