I am looking forward to chairing our town and village green (TVG) webinar tomorrow (12 May 2021) at 10am and will be joined by my colleagues Cathryn Tracey and Jen Ashwell who will be covering the test for TVG registration and issues surrounding it and an overview of protections and defences available to landowners and developers.
They will also be focusing on the key recent cases of T W Logistics Ltd v Essex County Council and another [2021] UKSC 4 (see our recent article on this case Village green risk – Supreme Court confirms threat of 'dual use' scenarios (burges-salmon.com) and R. (on the application of Lancashire CC) v Secretary of State for the Environment, Food and Rural Affairs [2019] UKSC 58.
Development can be completely thwarted in the case of a successful TVG registration so it’s an important issue to be aware of. Registration is still open so please do join us if you can: https://bsalmon.us/3enJyWs.
Town and village green registration is possible on land where there is ongoing commercial use that is compatible with the public’s use
