Overview

Emma joined Burges Salmon in October 2007, having previously had experience of dealing mostly with high value residential property transactions, both rural and urban.

Emma specialises in rural and agricultural property and has acted for individuals, institutional and corporate clients on a wide variety of transactional matters, including sales, purchases and lending instructions.

Emma has a great deal of experience in advising on agricultural tenancy matters both under the Agricultural Holdings Act 1986 and the Agricultural Tenancies Act 1995 including on complex restructuring matters involving the surrender and regrant of tenancies to facilitate strategic land use projects.

Emma also advises on the issues that arise from the ongoing management of farms and estates and has a particular interest in farm cottage tenancies.

Experience
  • Advising on the sale of a 4,700 acre multi-let, largely agricultural, estate for c. £50 million.
  • Advising on the sale of a portfolio of 50 rural cottages subject to protected residential tenancies to an investor purchaser for c. £8 million with negotiation of complex provisions to ensure future protection of tenants’ rights.
  • Advising on the purchase of an equestrian property for private high new worth individual for c. £6 million.
  • Advising on a complex surrender and re-grant arrangement under the Agricultural Holdings Act 1986 enabling the tenant to continue with their business on the holding whilst parts of it were the subject of gravel extraction works carried out by the landlord.
