About

Kieran is an Associate in the firm’s Edinburgh-based Dispute Resolution team.

His area of specialism is real estate disputes. However, he also has a background in general commercial litigation and experience of fatal accident inquiries. He has advocacy experience in the sheriff courts, arbitration and before the First-tier Tribunal (Housing and Property Chamber) and experience as an instructing solicitor for Court of Session actions. A large part of Kieran’s practice is advisory work, assisting transactional colleagues and clients on matters to prevent or mitigate the risk of disputes where appropriate.

Kieran is a Tutor of Property Law at the University of Edinburgh (2019-present) and the case law contributor for the Green’s Property Law Bulletin (2021-present). Kieran is also a key contributor in relation to the ongoing proposed reform of the termination of commercial leases in Scotland. He gave evidence before the Scottish Parliament’s Delegated Powers and Law Reform Committee on the Leases (Automatic Continuation etc.) (Scotland) Bill.

  • Major energy company: advised a major energy company defending a high-value dilapidations claim (arbitration).
  • High net worth individual: advising and appearing on behalf of a high net worth individual in a dilapidations claim concerning their property.
  • Holding company of a large construction firm: advising in respect of the defence of an Electronic Communications Code application by an operator.
  • REIT company: Advised a high value dilapidations claim (Court of Session).*
  • Regional housebuilder: Advised and appeared on behalf of a housebuilder client, securing summary judgment in their favour (sheriff court).*
  • National property factor: Advised and appeared on behalf of a property factor defending multiple code of conduct claims (First-tier Tribunal).*
