About

Perry is a senior associate in our Real Estate Disputes team, with more than 9 years’ experience advising clients on complex and high-stakes disputes, risk mitigation and litigation in the UK court system including the County Court, High Court, Court of Appeal, First-tier Tribunal (Property Chamber) and the Upper Tribunal (Lands Chamber).

He advises a wide range of clients in the real estate sector on contentious matters, including issues arising out of developments such as rights of light, vacant possession strategies, property-related insolvencies and building safety issues. Perry also has extensive experience advising landowners and site providers on matters and disputes relating to the Electronic Communications Code, including Code operator access requests, new and renewal Code agreements, securing termination of Code agreements and removal of telecoms mast sites to facilitate redevelopment.

Perry also routinely supports Burges Salmon’s transactional lawyers, providing strategic advice and managing risks on complex real estate transactions.

Perry is Chair of the Junior Property Litigation Association, and he is also a member of BPF Futures and the Property Litigation Association.

Experience

  • Prime Central London developer: Acting for a developer in novel telecoms litigation in the First-tier Tribunal (Property Chamber) against a major mobile network operator concerning radiation exclusion zones arising from 5G telecoms apparatus which prejudiced the developer’s ability to carry out its proposed Central London redevelopment.
  • High-profile property investor: Issuing and managing High Court rights of light litigation to prevent a neighbouring development which, as designed, would have adversely impacted the level of light enjoyed by the client’s historic City of London building.
  • Major infrastructure developer: Advising on development constraints relating to a DCO-approved, Nationally Significant Infrastructure Project, including advising on the developer’s options under Part 10 of the Electronic Communications Code and securing the removal of four telecoms mast sites to facilitate planned redevelopment works.
  • High-profile developer: Advising a high-profile developer on their proposed major redevelopment in Mayfair, including securing vacant possession of the site before commencement of works and providing strategic advice including on telecoms.
  • Major London developers: Advising the UK’s largest commercial property development and investment company and the developer of Europe’s largest urban regeneration project, in conjunction with their respective rights of light surveyors, on portfolio-wide light obstruction notice programmes to safeguard the future development potential of key sites.
  • Major developer: Advising a major developer in relation to their acquisition and multi-million-pound plans to develop a skyscraper in the City of London, including securing vacant possession of the site and providing strategic advice on telecoms.
