Employees are becoming increasingly familiar with their rights and protections under data protection laws which is having a knock-on impact for HR teams. With employers processing significant amounts of personal data, including ‘special category’ data, grievances, complaints, data subject access requests (DSARs) and other data protection issues may well arise, particularly in the context of employee disputes.

Alongside this, as technology and operational efficiencies evolve, HR teams need to be aware of the data protection issues which may come into play for employees.

How to efficiently and effectively manage DSARs

We are seeing a significant increase in the number of DSARs raised by employees (often as a precursor to an employment tribunal claim). We will outline the circumstances in which a DSAR can be raised by an employee, worker or job candidate and will share our tips for dealing with requests. We will also discuss how to approach some of the trickier DSAR issues that can crop up.

Employee monitoring

A combination of factors including hybrid working, a drive for productivity and ever-more sophisticated technology, means employers are increasingly looking to monitor their employees whilst at work. Monitoring can take many forms – from CCTV and bodycams, attendance logs and email and telephone monitoring through to keystroke-logging and browser monitoring. We will consider the key data protection and privacy issues employers need to take into account when using monitoring tools.

Handling complaints

With employees more aware of their rights, we are seeing a rising trend in employee grievances and complaints about misuse of their data and/or mishandling of DSARs. We will discuss how to approach employee complaints, including where they have involved the Information Commissioner’s Office. We will also address how to reduce the risk of complaints and the importance of ensuring your policies and procedures are up to date.
