‘Fit and proper’ test introduced by the Water (Special Measures) Act comes into force

The Infrastructure (Wales) Bill was passed by the Senedd on 16 April 2024. We previously published a blog summarising the Infrastructure (Wales) Bill (the “Bill”) which is linked here. The Bill was introduced to Senedd Cymru (the “Senedd”) in July 2023 and sets in place a new consenting process for significant infrastructure projects in Wales. The Bill replaces the existing DNS consenting regime, creating a more streamlined process which it is hoped will encourage investment into significant infrastructure projects in Wales.
Since the Bill was first introduced to the Senedd, the changes to it have been fairly limited. We have set out below what we consider to be the key changes between the Bill as introduced to the Senedd in 2023 and the Bill as passed.
The Bill is a framework bill and we will not know much of the detail until the secondary legislation is published for consultation, which we anticipate will be during the Summer or Autumn of 2024. This further detail is essential to enable practitioners and those involved in projects to better understand the details of the new regime and the extent to which it provides improvements to the existing regime.
In the meantime the Senedd has launched two consultations: the first is a call for evidence in relation to the pre-application consultation procedure, and the second is in relation to the fees for the consenting process. The consultations close on 22 July 2024.
