Overview

Matthew is a Senior Associate in the Burges Salmon Planning and Compulsory Purchase team. Matthew advises clients on a broad range of planning and compulsory purchase issues, including planning agreements and infrastructure provision in order to unlock delivery of large-scale, comprehensive schemes of development.

Matthew’s practice involves assisting clients on all practical, legal and strategic considerations required to deliver significant and ambitious development projects. His practice includes advising on planning strategy, Section 106 Agreements, permitted development, use classes, highways and the delivery of essential supporting infrastructure. 

Matthew also advises both public and private sector clients on contentious planning matters, including planning appeals, enforcement action and judicial review claims.

Experience
  • Advising the successful objector to the London Borough of Barking and Dagenham (Vicarage Field and surrounding land) Compulsory Purchase Order, which following a public inquiry, the Inspector opted not to confirm in October 2022.
  • Advising a London local authority client on two parallel CPOs to enable the redevelopment of 750+ residential units, delivering significant social and environmental improvements, and substantial benefits to the Council’s housing stock. Both Orders were confirmed without modification, following detailed engagement with local residents, and these are now being implemented.
  • Advising on an £11.5 million highway improvement project which is on track to deliver a new roundabout system in the north of England. The project will enable the sustainable development of 1,000+ homes in the locality. Matthew assisted the Council with all planning and funding arrangements, working in close collaboration with other stakeholders including the highway authority, local enterprise funders and National Highways.
  • Instructed by a registered provider client to provide comprehensive planning support in relation to a pioneering regeneration scheme for the provision of more than 1,500 affordable homes in a sustainable east London location. Planning permission has now been granted for the overarching outline and first phase.
  • Assisting a local authority client in obtaining and implementing a CPO required to deliver a new rapid transit system which will serve 6,250 new homes across the County. Matthew’s involvement included settling terms with the landowners for withdrawal of objections and advising and assisting the acquiring authority through to the conclusion of the GVD process.
  • Acting for a developer appealing against the non-determination of an application for a 258-dwelling scheme in a sustainable urban location in London, including assisting throughout the public inquiry process and negotiating the S.106 agreement.
  • Acting for a London local authority client on a CPO required to enable the £20m regeneration of the local high street, including successfully resisting a statutory challenge to the confirmation of the Order advanced in the High Court.
  • Assisting a local authority on all planning matters required to deliver a 2,500-home urban extension project in the West of England, including planning strategy, negotiating infrastructure agreements, briefing and supporting Members and supporting the authority throughout the planning process.
  • Defending a local authority’s decision to grant planning permission for the re-use of medical facilities, acting on behalf of a healthcare client in high-profile appearances at the High Court, Court of Appeal and Supreme Court.
