Overview

Our expertise ranges from initial advice to both landowner and operator clients in relation to their powers and rights under the Code, to running complex litigation in the Upper Tribunal (Lands Chamber). Our focus is to deliver strategic and cost-effective solutions to our clients and to mitigate the risks and challenges that the new Code presents for both operators and landowners. 

Alongside our Technology and Communications and Telecommunications teams, our specialist real estate disputes lawyers offer a full spectrum of telecommunications and Code expertise to both landowner and operator clients.

Key clients include: Severn Trent Water, Truespeed, Defence Infrastructure Organisation and Ministry of Defence, Crown Estate Commissioners and Transport for Wales.

Areas of focus

Our telecoms team can assist with all aspects of the Code.  Our expertise includes:
 
  • Advising and representing clients in Upper Tribunal (Lands Chamber) proceedings.
  • Negotiating Code agreements for landowner clients, with associated access policies and rate cards.
  • Negotiating interim agreements.
  • Advising landowner clients in relation to the service of Code notices and how these may impact their operations.
  • Advising clients in relation to existing Code agreement renewals and / or requests for new Code rights.

 

Experience

Advising Severn Trent Water on Code issues relating to its property portfolio, including advice in relation to its strategic sites and water towers.

Advising Truespeed in relation to the roll-out of its infrastructure and, specifically, site provider engagement and their powers under the Code.

Advising The Crown Estate Commissioners in relation to lease renewals under the Code.

Advising Transport for Wales on Code issues relating to the transfer of the Core Valley Lines from Network Rail.

Advising a global investment bank and service of Paragraph 31 Notices in accordance with the Code in order to bring 50+ agreements to an end.

Advising the Defence Infrastructure Organisation in relation to its property portfolio and how the Code may impact their operations.
