Overview

Nick is a partner in the firm's energy and utilities team. He heads Burges Salmon's resource and waste management team. He advises funders, developers, local authorities, waste contractors, fuel suppliers, large energy users and energy generators on a range of projects, contractual arrangements and regulatory issues in the energy sector and the circular economy space.

Nick's expertise includes:

  • biomass, anaerobic digestion, green hydrogen, sustainable aviation fuels, waste to energy and fuels projects
  • waste and fuel supply agreements
  • local authority waste collection and disposal
  • waste sector regulatory advice
  • leading on due diligence for waste/energy sector acquisitions
  • energy sector regulatory advice
  • offtake agreements including power purchase agreements, corporate PPA structures, heat supply agreements, private wire, digestate management
  • energy trading and energy supply agreements.

Experience
  • Advising Isle of Wight Council on the procurement and funding of a 25 year integrated waste collection, treatment and disposal contract and advising Devon County Council on Devon County Council on the procurement of the £65 million Exeter City EfW.
  • Advising the senior lender on commissioning and fuel supply issues associated with a UK based waste wood biomass CHP plant.
  • Advising Estover Energy on the development of three biomass CHP projects and associated heat and power offtakes: Speyside (15MWe), Cramlington (30MWe) and Kent (28MWe). Each project will provide heat and/or electricity over a private network to neighbouring energy users as well as exporting to the grid.
  • Leading the due diligence team for a European developer seeking to acquire two UK brownfield waste to energy gasification projects.
  • Advising Marks and Spencer plc on a wide range of energy issues, including: negotiating and advising on its long term 100% renewable electricity supply contracts for all stores in Great Britain, the acquisition of green gas certificates, deployment of the M&S Energy branded domestic energy supply, its award winning direct PPA/sleeving arrangements.
