Burges Salmon reflects on important conservation covenant for Woodoaks Farm Habitat Bank

Working closely with natural capital advisors Natural Asset Partners, we advised the Soil Association Land Trust (SALT) in 2025 on the creation of a conservation covenant and monitoring agreement to secure Biodiversity Net Gain (BNG) at Woodoaks Farm, a property owned by SALT. Introduced by the Environment Act 2021, conservation covenants are a relatively new legal mechanism in the property law of England and Wales.
The transaction marked SALT’s first step into BNG and represented a significant milestone for nature recovery at its Woodoaks Farm property in Hertfordshire. The initiative – the Woodoaks Farm Habitat Bank – is now registered and allocating biodiversity units to developers, enabling meaningful nature restoration while allowing SALT to retain control of its land and deliver its long-term vision for the charity.
Our Real Estate, Estates and Land and Projects teams advised on negotiations with Harry Ferguson Holdings Limited, the body responsible for overseeing and monitoring BNG delivery at the site. The project team was led by partner Ross Simpson, supported by senior associate Thomas Mark-Bell and associate Gabi Gershuny.
